TERMS OF SERVICE AGREEMENT

1. Acceptance of Terms

By accessing www.yawdfinds.com, the YawdFinds mobile application, and any related services (collectively, "YawdFinds" or "the Service"), you agree to be bound by these Terms of Service ("Terms") and all applicable laws and regulations of Jamaica. If you do not agree with any of these terms, you are prohibited from using or accessing this site.

2. Description of Service

YawdFinds is a digital marketplace connecting buyers and sellers of vehicles, real estate, and general goods in Jamaica.

• Venue Only: We are not a party to any transaction between buyers and sellers. We do not transfer legal ownership of items from the seller to the buyer.
• Verification: While we offer User Verification services to increase trust, YawdFinds cannot guarantee the true identity, age, and nationality of a user or the accuracy of their provided verification documents.

3. Use License

Permission is granted to temporarily download one copy of the materials (information or software) on YawdFinds for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title. Under this license, you may not:

• Modify or copy the materials;
• Use the materials for any commercial purpose, or for any public display (commercial or non-commercial) without our express written consent;
• Attempt to decompile, reverse engineer, or "scrape" any software or data contained on the YawdFinds website or app;
• Remove any copyright or other proprietary notations from the materials; or
• Transfer the materials to another person or "mirror" the materials on any other server.

This license shall automatically terminate if you violate any of these restrictions and may be terminated by YawdFinds at any time.

4. Accounts & Verification

• One Account Policy: Only one account is permitted per user. Duplicate accounts identified by our system may be merged or deleted.
• User Verification: To access certain features (such as "Verified Seller" badges), you may be required to provide government-issued identification. You warrant that all information provided is accurate and current.
• Security: You are responsible for maintaining the confidentiality of your login credentials.

5. Plans, Trials, and Advertising

YawdFinds currently offers free access, including a one-time 90-day Pro trial for eligible accounts. No payment method is required for the trial.

5.1 Plans and Pro Trial

Feature limits vary by plan. Business and Enterprise features shown as coming soon are not currently available for purchase.

• Trial duration: The Pro trial lasts 90 days from activation and may only be used once per account.
• Ending a trial: You may end the trial through your account settings. Ending it returns the account to the Free plan immediately, and the trial cannot be restarted.
• No automatic charge: The trial does not renew into a paid plan and does not create a payment obligation.

5.2 Advertising

YawdFinds may offer banner advertising or other promotional placements under separate written terms.

• No Guarantee: Advertising or promotional placement does not guarantee traffic, inquiries, or a sale.
• Availability: Advertising is not a self-service payment feature and may not be available at launch.

6. Content & Posting Rules

By making a Submission (posting ads, data, photos), you grant YawdFinds an irrevocable, perpetual, non-exclusive, royalty-free right to use, copy, distribute, reformat, and publicly display that content.

6.1 General Posting Rules

• Possession: You must have physical possession of the item or be a legally authorized agent.
• No Watermarks: Photos must be clean. You cannot place phone numbers, emails, or third-party logos on listing images.
• Accuracy: You are solely responsible for the truth and accuracy of your listing.
• Prohibited Items: You may not post: Drugs, alcohol, or tobacco products; Weapons, firearms, or ammunition; Adult content or sexual services; Stolen goods or counterfeit items; Loans, pyramid schemes, or "Get Rich Quick" offers.

6.2 Real Estate Specifics

• YawdFinds is an advertising platform, not a licensed real estate agent.
• Only owners, developers, or licensed agents may list properties.
• We reserve the right to request proof of ownership or authorization to list a property.

7. Disclaimer of Warranties

The materials on YawdFinds are provided "as is". YawdFinds makes no warranties, expressed or implied, and hereby disclaims all other warranties, including without limitation, implied warranties of merchantability, fitness for a particular purpose, or non-infringement of intellectual property. Further, YawdFinds does not warrant the accuracy or likely results of the use of the materials on its website.

8. Limitation of Liability

In no event shall YawdFinds or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on YawdFinds, even if YawdFinds has been notified orally or in writing of the possibility of such damage.

release: If you have a dispute with one or more users, you release YawdFinds (and our officers, directors, agents, and employees) from claims, demands, and damages of every kind arising out of such disputes.

9. Mobile Devices

If you are accessing YawdFinds via a mobile device or app:

• Data Charges: You are responsible for any mobile charges (data, SMS) incurred.
• Apple/Google: These Terms are between you and YawdFinds, not with Apple or Google. However, if you download our app from their stores, you must comply with their respective Usage Rules.

10. Governing Law

Any claim relating to YawdFinds shall be governed by the laws of Jamaica without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts of Jamaica.
